Preamble

This Digital Licence Agreement ("Agreement") sets out the terms under which you are permitted to use the digital products ("Products") sold by Studio Pi on drjohnmhogg.com. By completing a purchase, you confirm that you have read, understood, and agreed to this Agreement.

The Products covered by this Agreement include:

Mental Skills for Success: The Age Group Swimmer's Workbook (Ages 11–14)
Mental Skills for Success: The Senior Swimmer's Workbook (Ages 15+)
The Mental Skills Coaches Manual (Part 1, Part 2, and Part 3, each available independently)
Any additional products published by Studio Pi on this Site

All Products are the original intellectual property of Dr. John M. Hogg, published and distributed under licence by Studio Pi. All rights not expressly granted in this Agreement are reserved.

Part A — Licence Tiers

A1. Individual Licence

Who this is for: A single athlete, parent purchasing on behalf of an athlete, or a coach using the material exclusively in personal 1-on-1 coaching sessions.

What you may do:

Download and retain one personal copy of the Product
Print one copy for your own personal use
Use the printed or digital copy in a 1-on-1 coaching session that you personally lead

What you may not do:

Share the digital file with any other person, including other coaching staff or athletes
Print copies for distribution to a group, team, or squad (except as provided under the Coaches Manual Additional Rights below)
Use the material in group coaching, team sessions, or workshops (except as provided under the Coaches Manual Additional Rights below)

Coaches Manual — Additional Rights for Individual Licence Holders

If your Individual Licence covers any part of the Mental Skills Coaches Manual series (Part 1, Part 2, or Part 3), the following additional rights apply in recognition of the material's intended use as a professional coaching and teaching resource:

Athlete Materials: You are permitted to print individual exercises, charts, models, and reference materials from the purchased part and distribute physical copies to athletes under your direct coaching supervision for personal training and development purposes.
Interactive Workshops: You are permitted to display content from this PDF on a screen-share or projector during squad-based team meetings or mental skills workshops that you personally lead.
Digital Distribution Remains Prohibited: These additional rights are limited to physical print distribution and on-screen display only. Digital distribution of the file to athletes, other coaching staff, or any other party remains prohibited under this licence.

Term: Perpetual. Your licence does not expire. It is non-transferable — it belongs to you personally and may not be assigned to another individual or organization.

Age note: By purchasing this product, you confirm that you are 18 years of age or older, or that you are purchasing on behalf of a minor in your care. These products are not sold directly to minors.

A2. Squad Licence

Who this is for: A single coach working with one named training squad or group (e.g., Senior Performance Group, Varsity Swim Team, Regional Training Centre — Group B).

What you may do:

Print and distribute physical copies of the Worksheets to the athletes within your licensed squad
Distribute the digital PDF to athletes in your squad for their personal, non-commercial use on their own devices
Continue to use the material personally in future coaching roles (see "Coach Portability" below)

Squad size: This licence covers a maximum of 30 athletes and the immediate coaching staff directly responsible for that group, defined as the head coach plus up to two (2) assistant coaches.

Term & renewal:

Your personal right to hold and reference the material is perpetual
The right to distribute to or use with a specific group of athletes is tied to one named squad per licence purchase
If you move to a new role, new club, or begin working with a new group of athletes, a new Squad Licence must be purchased for that group
The personalized copy of the Product you received (bearing your squad's name and licence year) serves as your licence record for that group

Coach Portability: A coach who has purchased a Squad Licence retains the right to use the material as a personal reference and coaching tool indefinitely. The per-group restriction applies to distribution and active program use, not to the coach's ongoing professional development.

What you may not do:

Use this licence across multiple squads, tiers, or programs simultaneously
Host the file on any public or shared network (public Google Drive, school portal, Dropbox shared link, etc.)
Resell, re-license, or redistribute the material in any form

A3. Team / Club Licence

Who this is for: Organizations with more than one training group, or clubs wishing to deploy the material across multiple squads under unified organizational use.

Team and Club Licences are custom-quoted based on your organization's size, the number of squads, and the specific Products required.

General terms for Team/Club Licences:

Coverage up to a defined number of squads and athletes as agreed in writing at the time of purchase
Annual renewal — the licence term is one (1) calendar year from the date of purchase, after which a renewal licence must be purchased to continue organizational distribution
Coaching staff coverage includes all coaches directly employed by or contracted to the organization
All terms regarding prohibited uses (Section B) apply in full

A4. Federation / Association Licence

For regional sporting bodies, national associations, or organizations seeking multi-club or national deployment of these materials, please contact Studio Pi directly to discuss a custom licence arrangement.

Part B — The Coaches Manual: Series Licence

The Mental Skills Coaches Manual is published in three parts, each available for individual purchase. The following Series Licence terms apply:

B1. Licence Tier Travels With the Purchaser

When you purchase any part of the Coaches Manual, your licence tier (Individual, Squad, or Team/Club) applies to that part. If you subsequently purchase additional parts of the Coaches Manual, those parts are automatically covered under the same licence tier you established with your first purchase.

You do not need to upgrade your licence when adding further parts — your original tier extends to the complete series.

B2. Applicability

The Coaches Manual is currently written for competitive swimming coaches. Its licence terms, however, are sport-neutral. The material is intended for the coaching staff responsible for athlete mental skills development.

B3. Individual Part Purchases

Each part may be purchased independently. There is no obligation to purchase all three parts. Parts not yet purchased are not covered by any existing licence.

Part C — Prohibited Uses (All Tiers)

The following are prohibited under all licence tiers unless expressly authorized in writing by Studio Pi:

Resale or redistribution: You may not sell, sublicence, rent, lease, or otherwise transfer the Products or any rights therein to any third party
Public hosting: You may not upload or make these files available on any public website, open file-sharing network, social media platform, or publicly accessible cloud storage
Modification: You may not alter, edit, adapt, translate, or create derivative works from the Products. You may not remove, obscure, or alter any copyright notices, credits, author attributions, or personalized identifiers embedded in the file
Bundling: You may not bundle these Products with other offerings for resale or distribution without express written consent from Studio Pi
AI training: You may not use any part of these Products as training data for artificial intelligence or machine learning systems
Unauthorized reproduction: You may not reproduce substantial portions of the text in any other publication, course, or training program without express written consent

Part D — Personalized Files

Squad, Team, and Club licence purchases are fulfilled as personalized copies. Each file includes your organization's name and licence year embedded within the document.

Removal, alteration, or obscuring of this embedded identifier constitutes a material breach of this Agreement
The personalized identifier serves as Studio Pi's licence record and may be used as evidence in the event of unauthorized distribution
Personalized files are delivered manually within 1–3 business days of payment confirmation. Delivery is deemed complete when the file has been sent to the email address provided at checkout

Part E — Copyright & Ownership

All Products remain the intellectual property of Dr. John M. Hogg and Studio Pi at all times. This Agreement grants you a limited, non-exclusive, non-transferable licence to use the Products as described above. No ownership of the underlying content is transferred to you by virtue of this purchase.

The copyright notice embedded in all Products reads:

© [Year] Studio Pi. Written by Dr. John M. Hogg. All rights reserved.

This notice may not be removed.

Part F — Enforcement & Breach

If you breach any term of this Agreement:

Your licence is immediately terminated
Studio Pi reserves the right to pursue all available legal remedies under the Copyright Act (Canada) and applicable international law
You agree to indemnify Studio Pi and Dr. John M. Hogg against any costs, losses, or damages arising from your breach, including reasonable legal fees

Studio Pi reserves the right to periodically update this Agreement. Continued use of purchased Products constitutes acceptance of any updated terms.

Part G — Governing Law

This Agreement is governed by the laws of the Province of British Columbia and the laws of Canada applicable therein. Any dispute arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of British Columbia.
